A federal judge has dismissed a Trump Justice Department lawsuit that tried to use the Freedom of Access to Clinic Entrances Act against pro-Palestinian protesters connected to a 2024 event at a New Jersey synagogue. Yes, the same administration that narrowed use of the law around abortion clinics attempted to stretch it across a political protest. Consistency has apparently been placed in witness protection.

The FACE Act protects access both to reproductive-health services and to places of religious worship. The government accused organizations and individuals of intimidating people attending an event at Congregation Ohr Torah. Defendants argued that the complaint treated protected speech and assembly as unlawful obstruction.

The judge said the allegations did not clear the legal bar

The ruling did not declare every act around the protest admirable or harmless. It found that the government's pleadings failed to establish the specific intimidation, threat or interference required for the FACE Act claims against the defendants.

Court records show the dispute involved charged slogans, photographs and conduct that attendees found alarming. But constitutional cases turn on legally sufficient allegations, not on whether a demonstration produced anger, fear or cable-news footage.

Religious safety and political speech both matter

Jewish communities have legitimate reasons to demand security amid rising antisemitism. Protesters also retain First Amendment rights, including when their message is furious and unpopular. Courts must separate actual threats and blocked worship from advocacy the government dislikes.

Reuters reported the dismissal on October 2, 2026, and the federal order is publicly available. The government may appeal or revise its approach. For now, a law cannot become ideological Silly Putty simply because the Justice Department found a new target.
